These Terms govern your use of the website design, hosting, and maintenance service provided by AdvenSystem ("we", "us"). By subscribing, you agree to them.
1. What we provide
For the monthly fee, we provide:
- Design and build of a website for your business.
- Registration of a domain name on your behalf, in your business's name.
- Hosting, an SSL certificate, security protection, and daily backups.
- Search engine setup and submission.
- Ongoing content updates to your existing pages, performed by us at your request.
- Support by email or text message.
2. What is not included
The following fall outside the monthly fee and would be quoted separately before any work begins:
- Custom software development, booking systems, online ordering, or payment functionality.
- Logo design, professional photography, or videography.
- Copywriting beyond adapting the material you supply.
- Paid advertising management or ad spend.
- A complete redesign requested within twelve months of launch.
"Unlimited updates" means reasonable changes to the content of your existing site — text, images, hours, prices, menu items, adding or removing a page. It does not mean unlimited development work.
3. Fees, billing, and cancellation
The fee is $99 USD per month. There is no setup fee. Billing begins on the day your site goes live and recurs monthly on that date. Payments are processed by Stripe.
There is no minimum term. You may cancel at any time by emailing us. Cancellation takes effect at the end of your current billing period; we do not pro-rate partial months. We will not bill you again after you cancel.
30-day money-back guarantee. If you request a refund within 30 days of your first payment, we will refund that payment in full and transfer your domain to you at no cost.
If a payment fails, we will notify you and retry. If the account remains unpaid for 14 days, we may suspend the site. If it remains unpaid for 30 days, we may take it offline. Your domain and content remain yours throughout, and we will release them on request.
4. Your content and your rights
Everything you provide to us — logos, photographs, text, menus, trademarks — remains yours. You grant us permission to use it solely to build, publish, and maintain your website.
You confirm that you own or are licensed to use the material you send us, and that publishing it does not infringe anyone else's rights. You are responsible for the accuracy of the business information on your site, including prices, hours, and any claims about your products or services.
We may display your website and business name as an example of our work, unless you ask us in writing not to.
5. Your domain name
We register your domain in your business's name and pay the registration fee as part of your subscription. The domain is your property. If you leave us, we will transfer it to you or to a registrar of your choosing at no charge, along with an export of your website's content. We will not hold a domain hostage under any circumstances.
6. Ownership of the website
The visual design, code, and templates that we develop remain our intellectual property. Your subscription grants you the right to use your website for as long as your account is active. On cancellation you receive your domain and your content; you do not receive ownership of our underlying templates or code.
7. Acceptable use
You agree not to use our service to publish or distribute content that is unlawful, fraudulent, defamatory, obscene, infringing, or that promotes hate or violence. We may suspend or terminate service immediately for a breach of this section, without refund.
8. Availability
We target 99.9% uptime and monitor our infrastructure continuously. We do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and events outside our reasonable control may cause downtime. We will restore service as quickly as we can.
9. Disclaimers
We build websites; we do not guarantee business outcomes. We make no promise of any particular search ranking, volume of traffic, number of customers, or increase in revenue. Search engines control their own results and change them without notice.
Except as expressly stated in these Terms, the service is provided "as is" and we disclaim all other warranties to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.
Nothing in these Terms limits liability that cannot be limited by law.
11. Changes to these Terms
We may update these Terms. If a change materially affects your rights, we will give you at least 30 days' notice by email before it takes effect. If you do not agree, you may cancel before the change applies.
The monthly fee for an existing subscriber will not increase without at least 30 days' written notice, and you may cancel rather than accept an increase.
